§ 92.99. PENALTY.

  • (A) Any person who violates any provision of this chapter for which no other penalty is set forth shall be guilty of a misdemeanor and shall be fined not more than $500.

    (B) (1) A first offense for a violation of § 92.50 shall constitute a civil offense and shall be subject to a civil fine of not more than $50 pursuant to KRS 65.8801.
    (2) A second offense for a violation of § 92.50 shall constitute a civil offense and shall be subject to a civil fine of not more than $100 pursuant to KRS 65.8801.
    (3) A third offense for a violation of § 92.50 shall constitute a civil offense and shall be subject to a fine of not more $200 pursuant to KRS 65.8801.
    (4) A fourth or subsequent violation of § 92.50 shall be a misdemeanor and shall be subject to a criminal fine of not more $500 and sentence of up to ten days in jail or both.
    (5) Nothing herein shall prevent an enforcement officer, in his or her discretion, from issuing a warning in lieu of citation for a first offense.
