§ 31.40. BUILDING INSPECTOR; ASSISTANT.

  • (A) Establishment. The Office of Building Inspector is hereby established.
    (B) Appointment. The Building Inspector shall be appointed by the Mayor with the approval of the City Council pursuant to KRS 83A.080; and may be removed by the Mayor at will, except as otherwise provided by statute or ordinance.
    (C) Oath; bond. No person shall be appointed or act as the Building Inspector unless such person has taken the oath required by § 228 of the Constitution of the Commonwealth of Kentucky and has provided a bond in the sum as established by City Council, with corporate surety authorized to transact business in Kentucky and conditioned upon the performance of the duties specified herein.
    (D) Powers and duties.
    (1) It shall be the duty of the Building Inspector to administer, execute and enforce the provisions of the official building, housing and zoning ordinances of the city.
    (2) The Building Inspector shall take any action as permitted by law to correct the violations of the provisions of the official building, housing and zoning ordinances of the city.
    (3) The Building Inspector shall have the authority to order discontinuance of illegal use of land, buildings, structures, signs, fences or additions, alterations or structural changes.
    (E) Compensation. The compensation of the Building Inspector shall be in an amount to be established by City Council by ordinance.
    (F) Assistant to Building Inspector.
    (1) There is created the Office of Assistant to the Building Inspector to be filled by appointment of the Mayor with the approval of the City Council.
    (2) The Assistant to the Building Inspector shall perform those duties as are required of him or her by the Building Inspector or other ordinances of the City Council.

    (3) Divisions (C) and (E) above, concerning oath, bond and compensation, shall also apply to the Assistant to the Building Inspector.
