§ 37.131. VOTING LEAVE.

  • (A) Any employee entitled to a vote at any election in the state shall, if he or she has made application for leave prior to the day he or she appears before the County Clerk to request an application for a special ballot or prior to the day of election, be entitled to absent himself or herself from work for a period of one hour on the day he or she appears before the Clerk during normal business hours of the office of the Clerk or on the day of the election between the time of opening and closing the polls. The person shall not, because of so absenting himself or herself, be liable to any penalty. The employee’s supervisor may specify the hour during which the employee may absent himself. No supervisor shall refuse an employee the privilege hereby conferred, or discharge or threaten to discharge an employee or subject an employee to a penalty, because of the exercise of the privilege.
    (B) An employee must apply for voting leave, in writing, by 9:00 a.m. of the day before the election.
